Is Bellingham a Safe Area for Cyclists?

Is Bellingham a Safe Area for Cyclists?

Bellingham has developed a strong cycling culture that attracts commuters, recreational riders, and outdoor enthusiasts alike. Cyclists regularly travel through downtown Bellingham, along the South Bay Trail and Interurban Trail, around Boulevard Park, and between neighborhoods via roads such as Samish Way, Lakeway Drive, and Meridian Street. The city’s commitment to active transportation has also led to significant investment in cycling infrastructure, including the ongoing implementation of Bellingham’s Bicycle Master Plan to create safer, better-connected routes throughout the community.

While these improvements have strengthened Bellingham’s reputation as one of Washington’s most bicycle-friendly cities, they have not eliminated the risk of serious collisions with motor vehicles. In this article, our Bellingham bicycle accident attorneys explore the infrastructure, traffic laws, and local safety initiatives designed to protect cyclists, examine where bicycle accidents are most likely to occur, and explain the legal options available to injured riders under Washington law.

Bellingham’s 2024 Bicycle Master Plan

The original Bicycle Master Plan was adopted in 2014, and many of its recommendations have since been completed or revisited as Bellingham has grown. The 2024 update identifies priority projects across Bellingham, including new on-street bicycle connections, protected bike lanes, improved intersections, green bike boxes, and safer crossings. Together, these improvements are intended to create a more connected network and reduce the risk of collisions between cyclists and motor vehicles.

Why Was the Plan Developed?

As Bellingham has grown, the city has identified areas where cyclists would benefit from safer and better-connected routes. The updated plan prioritizes projects that close gaps in the existing network, improve intersections, and make cycling more accessible for riders of all ages and abilities.

What Changes Are Being Proposed?

The 2024 update proposes almost 200 new on-street bicycle connections, additional off-street routes, intersection improvements, and upgrades to existing bikeways. Priority projects include protected cycle lanes, green bike boxes, pavement markings, safer crossings, and other features that better define space for cyclists while improving awareness among motorists.

Do Bicycle Accidents Still Occur?

Despite continued investment in cycling infrastructure, bicycle accidents continue to occur in Bellingham. While projects identified in the 2024 update should make the city’s cycling network safer over time, cyclists remain vulnerable when motorists fail to yield, pass too closely, drive distracted, or otherwise act negligently.

Where Are Cyclists Most at Risk in Bellingham?

Bicycle accidents can happen anywhere in Bellingham, but certain roads, intersections, and recreational areas present greater risks because of higher traffic volumes, turning vehicles, or interactions between cyclists and motorists. Some of the most common locations include:

  • Downtown Bellingham: Left-turn collisions, dooring accidents, and crashes involving drivers who fail to yield are more common due to on-street parking, busy intersections, and significant pedestrian activity.
  • Meridian Street: Heavy commercial traffic, numerous driveways, and frequent turning vehicles increase the risk of collisions involving motorists entering or exiting businesses, changing lanes, or failing to check for approaching cyclists.
  • Samish Way and Western Washington University: High volumes of students, buses, pedestrians, and cyclists can create a challenging traffic environment where distracted driving, failure to yield, and turning collisions are common concerns.
  • Lakeway Drive and Interstate 5 Interchanges: Faster-moving traffic, merging vehicles, and complex intersections can make it more difficult for motorists to spot cyclists, increasing the likelihood of unsafe passing, right-turn collisions, and failure-to-yield accidents.
  • Fairhaven and the South Bay Trail: Recreational cyclists frequently travel through this area, where trails intersect with roads, parking lot entrances, and busy junctions. Drivers entering or crossing these routes without checking for cyclists can cause serious collisions.

If you have been injured in one of these locations or elsewhere in the city, the Bellingham bicycle accident attorneys at Walton Injury Law can help you pursue compensation for medical expenses, lost wages, and other accident-related losses.

What Rights Do Cyclists Have Under Washington Law?

Certain Washington laws protect cyclists and preserve their right to pursue compensation if they are injured because of another party’s negligence. These include:

Washington’s Safe Passing Law

Under RCW 46.61.110, cyclists have the right to be passed safely by motorists. Drivers overtaking a bicycle traveling in the same direction must leave at least three feet of space or move into another lane when it is safe to do so. If there is not enough room to pass safely, motorists should remain behind the cyclist until they can overtake without creating a hazard.

Drivers’ Duty of Care

Motorists have a legal duty to exercise reasonable care around cyclists. This includes obeying traffic signals, yielding the right-of-way when required, checking for cyclists before turning or opening a vehicle door, and remaining alert for riders when entering or leaving driveways, parking lots, and side streets. When drivers fail to meet this duty and cause a bicycle accident, they may be held liable for the injuries and losses that result.

Washington’s Comparative Fault Rule (RCW 4.22.005)

Under RCW 4.22.005, Washington follows a pure comparative fault system. This means injured cyclists have the right to recover compensation even if they were partly responsible for an accident. Any damages awarded are reduced by the cyclist’s percentage of fault rather than being barred altogether.

Statute of Limitations (RCW 4.16.080)

RCW 4.16.080 generally gives injured cyclists three years from the date of a bicycle accident to file a personal injury lawsuit. Although three years may seem like a long time, evidence is often easier to obtain when legal advice is sought soon after the collision.

Our Bellingham bicycle accident attorneys can guide you through the legal process and help ensure these laws are applied appropriately to your circumstances.

What Should You Do After a Bicycle Accident in Bellingham?

Taking the following steps can help protect both your health and any potential legal claim.

Seek Medical Care

A cyclist does not have the protection of a vehicle, so injuries such as concussions, fractures, and internal injuries can occur even in relatively low-speed collisions. A medical evaluation can identify injuries that are not immediately apparent and create a record of those injuries.

Report the Collision

A police report provides an independent record of the collision, including the location, those involved, witness details, and the responding officer’s observations. This information may become important if liability is later disputed.

Document and Preserve Evidence

Photographs of the bicycle, vehicle, road layout, traffic controls, visible injuries, and the accident scene can help establish how the collision occurred. It is also worth preserving damaged helmets, clothing, lights, and the bicycle itself until the claim has been resolved, as they may provide valuable evidence.

Exercise Caution When Speaking With Insurers

If an insurance adjuster contacts you, provide accurate factual information, but avoid speculating about how the collision occurred or accepting blame before all the facts are known.

Contact A Bicycle Accident Attorney

A bicycle accident attorney can review the circumstances of the collision, assess whether Washington traffic laws were violated, and advise whether you may have grounds to pursue compensation.

Walton Injury Law’s Approach to Bicycle Accident Cases

Once you contact Walton Injury Law, we can begin:

Reconstructing the Accident

We analyze the available evidence to determine how the collision occurred. This includes reviewing the police report, photographs, witness statements, surveillance footage, and damage to the bicycle and vehicle to establish the sequence of events.

Assessing Whether Traffic Laws Were Violated

We evaluate whether the driver failed to yield, passed too closely, made an unsafe turn, opened a vehicle door into the cyclist’s path, or committed another traffic violation that contributed to the collision.

Documenting the Full Extent of Your Losses

Our attorneys calculate both your economic and non-economic damages. This may include medical expenses, future treatment costs, lost income, reduced earning capacity, damage to your bicycle and cycling equipment, and pain and suffering.

Negotiating With the Insurance Company

We prepare and present the evidence supporting your claim, respond to liability disputes, and negotiate with the insurer in an effort to reach a fair settlement that reflects the full extent of your losses.

Taking Your Case to Trial if Necessary

Where settlement negotiations are unsuccessful, we are prepared to litigate your case and present the evidence supporting your claim before a judge or jury.

What Compensation Can You Recover After a Bicycle Accident?

The value of your bicycle accident claim depends on the severity of your injuries and the impact they have had on your daily life. Depending on your circumstances, you may be entitled to recover compensation for:

  • Medical Expenses: Emergency transportation, hospital treatment, surgery, diagnostic imaging, physical therapy, prescription medications, rehabilitation, and any future medical care related to your injuries.
  • Lost Income and Reduced Earning Capacity: Income lost while recovering from the accident, together with future losses where long-term injuries prevent you from returning to the same job or working the same number of hours.
  • Pain and Suffering: Compensation for the physical pain, emotional distress, loss of enjoyment of cycling and other activities, permanent scarring, and any ongoing impact the injuries have on your daily life.
  • Bicycle and Property Damage: The cost of repairing or replacing your bicycle, helmet, cycling computer, lights, riding apparel, eyewear, phone, and any other personal property damaged in the collision.
  • Wrongful Death Damages: If a bicycle accident results in a fatality, certain surviving family members may be entitled to pursue compensation for funeral and burial expenses, lost financial support, and other damages available under Washington law.

When pursuing a personal injury claim in Washington, it is essential to account for both your immediate and long-term losses. Our bicycle accident attorneys work with your treating physicians, life care planners, and other professionals, when appropriate, to help ensure any compensation reflects the full extent of your current and future needs.

A Proactive Approach to Cyclist Safety

Bicycle accident cases require an understanding of the roads, intersections, and infrastructure where collisions occur. Our attorneys closely follow updates to Bellingham’s Bicycle Master Plan, local cycling infrastructure projects, and changes to Washington bicycle laws to ensure our legal strategies reflect the latest developments affecting cyclists.

Trial Readiness

Although we aim to resolve bicycle accident claims through skilled negotiation whenever possible, we will not recommend accepting less than your claim is worth. If a fair settlement cannot be reached, we are fully prepared to take your case to trial and continue pursuing the compensation you and your family needs for the future.

Frequently Asked Questions

Below are some of the most common questions we receive from injured cyclists throughout the Bellingham community.

Can I Recover Compensation if I Was Not Riding in a Cycle Lane?

Yes. Washington law does not require cyclists to use a cycle lane simply because one is available, so riding on the roadway does not automatically prevent you from bringing a claim.

What if the Driver Says They Did Not See Me?

Drivers have a legal responsibility to look for cyclists before turning, changing lanes, or pulling away from the curb. Failing to see a cyclist can itself be evidence that the driver failed to keep a proper lookout.

What if the Driver Fled the Scene?

A hit-and-run does not necessarily end your claim. Police investigations, surveillance cameras, witness statements, and your own uninsured motorist coverage may still provide a path to compensation.

When Should I Contact an Attorney?

The sooner an attorney becomes involved, the sooner evidence can be secured before it disappears. This includes CCTV footage, witness statements, the damaged bicycle and helmet, and the driver’s vehicle, where available.
